ARTICLE 1 – GENERAL PRINCIPLES
1.1 BattleKart Europe SA with offices located at 20A rue du Valemprez, 7711 Mouscron (Belgium) registered with the Belgian Crossroads Bank of Enterprises (BCE) under number 0525.657.054, hereinafter referred to as BattleKart, operating a website with the address http://genk.battlekart.com/ (hereinafter the “Website”).
1.2 All the personal data that we collect (hereinafter the “Data”) will be processed in compliance with Belgian and EU legislation applicable to personal data protection, in particular the (EU) Regulation 2016/679 of the European Parliament and Council of 27 April 2016 regarding the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/CE (General Data Protection Regulation, “GDPR”), Directive 2002/58/CE, modified by Directive 2009/136/CE and the law of 13 June 2005 called the “Law relating to electronic communication” modified by the law of 10 July 2012.

2.1 The Policy describes the measures taken for the processing and the management of your Data during the use of the Website and your rights as a user of the Website.
2.2 The Policy applies to all the services proposed by BattleKart through the Website.

3.1.1 Data provided by the users. We collect the Data that you communicate to the Website in order to allow BattleKart to provide you with an easy, personalised and intuitive experience of your reservation on our website.

If you do not consent or you cannot authorise the collection or the processing of your Data as described in this Policy, please do not use this Website.

ARTICLE 4: PURPOSE OF THE DATA PROCESSING
4.1 The Data that we collect is used to process your participation in the BattleKart games. It is also used to improve the services that we propose by informing us of your interests concerning the operations, the performance and the support of our services.
4.2 We may use the Data collected ourselves or through various supports with the aim of promotional, commercial or informational communication. In this context, to allow you to achieve more through the Website and to keep you informed of new developments as well as our best promotional offers of the moment, we can propose free information letters. Unless you object, if you have used the services of BattleKart, we can send you emails with information about the use of the Website as well as our promotional offers.
4.3 We may also use this Data for the purpose of studies aimed at improving our services.
4.4 We may also be obliged to divulge your Data if it is necessary in order to (a) respect the applicable laws or to respond to an order or an injunction from the Courts and Tribunals, or to (b) protect and defend our rights or those of the Website users.
4.5 We may share your personal Data with our direct marketing Partners by email, if you choose to receive our promotional communications. In all cases, we will take all reasonable measures to ensure that these companies respect this Policy. Our policy is to prohibit these companies from using your Data for any purpose other than to provide the products and/or services specifically requested by BattleKart.
4.6 We will also transfer your Data to our ERP/invoicing software provider, Sellsy, with the purpose of ensuring the provision of services through our website. Our database and website development administrators naturally have access to your data but can only use them for testing the website developments.
4.7 We may “anonymise” the Data by removing personally identifiable elements such as the name and email address, and grouping the data to use it in the context of market studies or other professional purposes. We may then divulge this anonymised information to third parties.
4.8 Aside from the cases described in this article, we do not allow the sale or the transfer of Data to third parties without your approval. The managers of BattleKart franchised centres will be able to carry out searches on a user in our database.
ARTICLE 5: RIGHT TO OBJECT
5.1 You have the right to object to the processing of your data as well as to their use for prospecting, in particular commercial prospecting. 5.2 To unsubscribe from our information letters, you can exercise your right to object by clicking on the unsubscribe link which is at the bottom of each of our information letters. The requests to unsubscribe will only be effective if you receive a message of confirmation. If this is not the case, you may exercise your right to object as foreseen in article 6.1 of this Policy.
ARTICLE 6: RIGHT OF ACCESS, RECTIFICATION, ERASURE AND RESTRICTION OF PROCESSING
6.1 You have a right of access, rectification, erasure and the restriction of processing of data that relates to you, in accordance with articles 15, 16, 17 and 18 of the GDPR.

ARTICLE 7: RIGHT TO DATA PORTABILITY
You also have the right to receive the Data that relates to you and that you have provided to BattleKart, in a structured, commonly used and machine readable format and have the right to transmit this data to another person responsible for data processing if the data processing is carried out by automated means.
ARTICLE 8 : COOKIES
8.1 Cookies consist of data sent to your terminal from your browser when you visit the Website and they contain a unique identification number. Cookies make the access to the Website easier as well as the navigation, and they increase the speed and efficiency of use of the Website. They may also be used to individualise the Website according to your personal preferences. Cookies also make it possible to analyse the use of the Website.
8.2. BattleKart informs you of the types of cookies used on the Website:
- Analytics cookies (Google Analytics, Facebook);
- The cookies used make it possible to keep a trace of the elements registered in your customer account;
- Session cookies are used to facilitate your use of the Website by remembering certain data relating to you (site language, login-password for access to your account, etc.).

To ensure the protection of the Data collected, we have put in place a security program for the information stored in these systems. In addition, our computer systems use data encryption and a software protection device.
ARTICLE 10: RIGHT OF COMPLAINT
Without prejudice to any other administrative or legal remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged violation, if you consider that the processing of your Data infringes the GDPR.
